Terms of Use

1. Terms

This document defines the general terms that apply to all online courses supplied by EcoStar Dangerous Goods Training Online Ltd (hereafter referred to as EDGTO).

By accessing this website you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

If you do not agree with any of these terms, you are prohibited from using or accessing this site.

The materials contained in this website are copyright of EDGTO.

2. Use License

Permission is granted to temporarily download one copy of any downloadable materials on the website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • modify or copy the materials;
  • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  • attempt to decompile or reverse engineer any software contained on the website;
  • remove any copyright or other proprietary notations from the materials; or
  • transfer the materials to another person or 'mirror' the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by EDGTO at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Disclaimer

The materials on the EDGTO website are provided 'as is'. EDGTO makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, EDGTO does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall EDGTO be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the website, even if EDGTO has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Revisions and Errata

The materials appearing on the EDGTO website may include technical, typographical, or photographic errors. EDGTO does not warrant that any of the materials on its website are accurate, complete, or current. EDGTO may make changes to the materials contained on its website at any time without notice. EDGTO does not, however, make any commitment to update the materials.

6. Links

EDGTO has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by EDGTO of the site. Use of any such linked website is at the user's own risk.

7. Site Terms of Use Modifications

EDGTO may revise these Terms of Use for its website at any time and without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use.

8. Provision of Online Learning

While we make every effort to ensure that our servers and those of our partners are online and functioning properly, we can not guarantee that the website will always be available with 100% up time. EDGTO will not be held liable and does not warrant that this website, any software, and any websites, applications or software controlled by EDGTO will be available at any time.

In order to keep our administration costs to a minimum and remain competitive in the market place we operate in, we do not engage in customer framework or tender applications, supplier audit requests or join supplier portals.

Payment must be made in full, in GBP, via bank transfer or through card payment online before course access is provided.

9. Enrolments, Course Access and Course Registrations

To enrol on a course, EDGTO requires your name and email address. An email address can only be used once for each account. These details must be provided accurately by you at the point of registration.

The email account linked to the email address must be capable of receiving our enrolment notification emails. You may be required to click on one or more of these emails in order to confirm your email address and complete the registration. If your security software or anything outside of EDGTO’s control blocks these emails and you are unable to complete the registration process, EDGTO accepts no liability, implied or otherwise, if you can not access the website due to the failure of software and servers to accept our incoming emails.

Once a user is assigned to a course and a registration is created on that course, the website may require the user to confirm their email address. The link provided in the email to do this expires after 7 (seven) days. EDGTO accepts no liability if a user fails to access and complete the registration process within this time. If EDGTO is required to manually reset a user’s registration and password, this is subject to an administration charge of £25.00 (plus VAT if applicable) per user.

In order to provide a secure website, part or all of the website may at any time use software which prevents denial of service attacks or other malicious activity. IP addresses are monitored and multiple website requests from the same IP address may result in a denial of service. This may happen when a virtual server or network is used to access the website for multiple users at the same time. EDGTO accepts no liability if you are unable to access the website and training material when using a network, group network, virtual network or virtual server.

If you require a name correction, please notify us within 24 hours of registration. Any amendments to the name or any details associated with the account after 24 hours from the time of registration will be subject to an administration charge of £25.00 (plus VAT if applicable) per amendment, per user, per course.

Once a registration has been created for a course, this is not transferrable. If you make a mistake during the registration process, please notify us within 24 hours of registration. Any amendments after 24 hours will be subject to an administration charge of £25.00 (plus VAT if applicable) per amendment, per user, per course.

Upon purchase of a course, our systems and servers complete background tasks and registrations in order to facilitate the services we provide. These background operations incur a cost to us, which we cover with the purchase price of the course. For this reason, no refunds will be given for course purchases, unless required under EU consumer protection law.

10 Governing Law

Our engagement is governed by and construed in accordance with the laws of England and Wales. You agree that the English Courts will have exclusive jurisdiction in relation to any claim, dispute or difference concerning these Terms, and any matter arising from them. Each party irrevocably waives any right it may have to object to any action being brought in those courts, to claim that the action has been brought in an inappropriate forum, or to claim that those courts do not have jurisdiction.
